EPCC Contract for a Large-Scale Solar Photovoltaic Project in Sabah

Our Projects & Infrastructure practice group, led by Kevin Richard Nathan, Head of Projects & Infrastructure, together with Aireen Natasha Ab Wahab, Associate, advised the EPCC contractor on the construction and development of one of the largest solar photovoltaic facilities in Sabah with a project value of approximately RM60 million.

The Firm was engaged to negotiate and structure the Engineering, Procurement, Construction and Commissioning (EPCC) contract, ensuring alignment with prevailing industry standards while addressing the legal and commercial risks associated with large-scale renewable energy projects.

Key contractual considerations included performance guarantees, grid integration requirements, supply chain risks, and regulatory compliance within the renewable energy sector. Particular attention was given to risk allocation and contractual mechanisms supporting financing considerations and long-term project bankability, while maintaining operational flexibility for the EPCC contractor.

This engagement demonstrates the Firm’s experience in advising on complex renewable energy infrastructure projects and structuring commercially balanced contractual frameworks for large-scale solar developments.
