Our Dispute Resolution practice group, led by Hoong Min Cheah and assisted by Najihan Kamarolzaman successfully represented our client in defending claims filed by two former employees before the Labour Court. The claims related to alleged unlawful salary deductions, salary withholding, claims for unused annual leave and miscellaneous allowances under their respective service contracts.

Through cross-examination, detailed written submissions and reliance on documentary evidence, we demonstrated that all deductions were lawful statutory obligations, withholding of salary was just and fair that the employees were not entitled to payment for unused annual leave and that the alleged miscellaneous allowances were claim-based and unsubstantiated. The Industrial Court dismissed the Complainants’ claims in their entirety.

This favourable outcome safeguarded our client from potential financial liabilities amounting to RM139,592.44 and reinforced the enforceability of its employment policies. The matter reflects the Firm’s ability to provide strategic employment law advice, manage complex employee disputes and achieve outcomes that protect clients’ operational and financial interests.
