Strategic Defense Against Unfair Dismissal Allegations in the Industrial Court

Our Dispute Resolution team, led by Brandon Cheah, Head of Dispute Resolution, and Azrul Haziq, Senior Associate, successfully defended an unfair dismissal claim before the Industrial Court of Malaysia.

The claim concerned a former Senior Quality Controller Engineer who contested his termination on the grounds of redundancy, alleging victimisation and unfair labour practice. We advised our client on all aspects of its defence, including the legal justification for the redundancy, the differentiation between the terminated role and a newly created position, and the procedural fairness of the termination process.

This matter raised important issues relating to redundancy, unfair dismissal, and evidentiary standards under Malaysian industrial law. It highlights our team’s capability in navigating complex employment disputes with strategic focus and clarity.
