Capabilities

  • Represented the Client in defending against a passing off claim by Golden Damascus Diversifies over the use of the name “Damascus” and the alleged imitation of the conceptual interior design and layout of Damascus Bukit Bintang. We also acted for the Client in opposing the application for interlocutory injunction wherein the Plaintiff applied for the Client to be restrained from using the name “Damascus” or “Damascus Delights” pending the disposal of the Writ of Summons. (Case No.: WA-22IP-94-09/2025)
  • Represented a dental healthcare service provider and its shareholders in initiating action against a company for infringement of trademark and sub claims for unpaid medical services. (Case Number: JA-22NCVC-137-09/202)
  • Advised on the registrability of a stylized word mark in Malaysia and acted as the trademark agent for the Client in commencing the trademark registration process at the MyIPO. We also advised the Client in ensuring a overall protection of the mark for international filings through the Madrid Protocol.
  • Acted for and advised the Client in securing expedited examination to shorten the overall timeframe for the registration process. This ensures that the Client’s brand elements receive earlier statutory protection, reducing the risk of misuse by third parties and strengthening the Client’s position in both domestic and international academic markets.
  • Acted as Trademark Agent for a company specialising in baby care and lifestyle products, assisting in the appeal against provisional refusals issued by the Intellectual Property Corporation of Malaysia (MyIPO). The work included analysing the grounds of refusal, preparing written submissions, and addressing the Registrar’s objections to secure the continued progress of the trademark applications.
  • Acted as Trademark Agent for a private higher education institution, managing the filing of its official crest as a trademark with the Intellectual Property Corporation of Malaysia (MyIPO). The engagement covered the preparation and submission of application documents and monitoring of the filing process to ensure smooth registration.
