Legal Alert | Commencement of ANTI-BULLY (TRIBUNAL FOR ANTI-BULLY) REGULATIONS 2026 (P.U. (A) 223)

The Tribunal for Anti-Bully Regulations 2026 [P.U. (A) 223] came into force on 16 June 2026, establishing the procedural framework for the Tribunal under the Anti-Bullying Act 2026.

The Anti-Bullying Act 2026 establishes a dedicated legal framework to address bullying complaints and to prevent and manage bullying cases in educational institutions and other institutions under the purview of specified Ministries. The Tribunal for Anti-Bully Regulations 2026 [P.U. (A) 223] (“the Regulations”) came into force on 16.06.2026, on which the Tribunal for Anti-Bully was officially launched (“the Tribunal”). The Regulations govern the procedural framework for the commencement and conduct of proceedings before the Tribunal (“the Tribunal”).

The Tribunal is empowered to receive, hear, and determine bullying complaints lodged by victims or their guardians, providing an accessible forum for redress. It is presided over by a President and members with relevant expertise in legal, psychological and child development fields. The Tribunal operates from the Asian International Arbitration Centre (AIAC), Kuala Lumpur, and is organised into six (6) regional zones – Northern, Southern, East Coast, Central, Sabah and Sarawak. The Tribunal may award compensation of up to RM250,000 and grant appropriate orders for the protection and welfare of victims, and facilitate mediation between parties, with any agreed settlements recorded and given binding effect.

The Act presently applies to persons aged 18 years and below, across institutions under the Ministry of Education, MARA, Ministry of Defence, Ministry of Women, Family and Community Development, and Ministry of Home Affairs. The Government has expressed its intention to study the potential expansion to cover individuals aged 18 and above, as stated by Minister Datuk Seri Azalina Othman Said during the winding-up of the parliamentary debate on 03.12.2025.

The commencement of the Regulations on 16.06.2026 marks a significant milestone in Malaysia’s legislative evolution on child protection and institutional accountability.
